970.5227-6 Patent indemnity—subcontracts.
Insert the following clause in solicitations and contracts in accordance with 970.2702-70:
Patent Indemnity—Subcontracts (DEC 2000)Except as otherwise authorized by the Contracting Officer, the Contractor shall obtain indemnification of the Government and its officers, agents, and employees against liability, including costs, for infringement of any United States patent (except a patent issued upon an application that is now or may hereafter be withheld from issue pursuant to a secrecy order by the Government) from Contractor's subcontractors for any contract work subcontracted in accordance with FAR 48 CFR 52.227-3.
